Town and Country Planning
Planning Problems
Town and Country Planning issues are often complex and involve an emotional response
from those involved. Whether you are applying for planning permission for your commercial
or residential property or are objecting a planning application made by a neighbour,
we can help.
Our Solicitors have extensive experience and can help at all stages of planning
applications and appeals. In particular we can advise on the following
- The best way of making a planning application to maximise the chances of success,
as well as the current planning policies and guidelines of Local Authorities and
Central Government
- We can give advice and assist in the negotiation of ancillary planning agreements
(often known as Section 106 Agreements). These agreements can often be a pre-requisite
to the grant of a Planning Permission and whilst most are quite specific in nature
often cover matters such as affordable housing, public open spaces and other “planning
gain”.
- If you are concerned about a neighbour’s planning application, we can advise you
on the best way to oppose and object to the application, either to achieve a suitable
alteration to the application or to block the application altogether.
- We also advise on and deal with applications for Certificates of Lawful Use to legitimise
the use of property which would otherwise be in breach of planning regulations.
- We can help you with planning appeals and enforcement action, including advising
on the costs and chances of success, and we can represent you at appeal either through
written representations, hearings or full public enquiries.
Appeals and Enforcement
- We can advise in relation to already existing planning permissions including dealing
with variations or removal of planning conditions. We have extensive experience
in dealing with the removal of occupancy conditions and alterations of use of both
commercial and residential properties.
- We can help you with planning appeals and enforcement action including advising
on the costs and chances of success, and we can represent you at appeal either through
written representations, hearing or full public enquiries.
- We can advise on the challenging of any planning permission already granted including
the possibility of a judicial review and, if necessary, complaints to the Ombudsman
and District Auditor about Local Authorities’ actions and decisions.
Additional Planning Problems
We can help with a whole range of ancillary matters, including highway agreements
and other service related issues such as the provision and maintenance of water
and sewage supplies and the management of public open spaces or common areas.
