What is a Lasting Power of Attorney (LPA)?

An LPA is a document that allows a person of your choice to deal with your affairs. This can include all money, savings, investments and property, but can be restricted.


Who can make an LPA?

Anyone can make an LPA as long as they understand that:
  • an attorney can take complete control over your affairs if you become mentally unable to manage them yourself;


  • an attorney will be able to do anything with your property that you could;


  • if you become mentally incapable the LPA can only be brought to an end by the Court of Protection.

Who can be an Attorney?

Anyone who is over the age of 18 years who is willing to act as your attorney and who at the time of signing the LPA is not bankrupt and in the future does not become bankrupt.


Can I revoke an LPA?

An LPA can be revoked at any time before it is registered at the Court of Protection. Once an LPA has been registered at the Court of Protection, only the Court can revoke it.


When does an LPA have to be registered?

An LPA must be registered with the Court of Protection by your attorney if he or she has reason to believe that you are or are becoming mentally incapable of managing your own affairs.


What will an LPA cost?

We currently charge a fixed fee of £90 plus VAT. If an LPA is made at the same time as a Will we offer reduced fees. Please ask your advisor about this.


The procedure

It will be necessary to make an appointment to discuss your needs. It would be helpful to bring with you the full names and addresses of anyone you are considering appointing as your attorney.


What if I find it difficult to attend one of our offices?

We are happy to make home visits to the elderly and infirm. Please ask your advisor for details of this service.


Where shall I keep the LPA?

We can store it for you free of charge and supply you with a copy for your own records.
