Children disputes involving Social Services
It is a very distressing matter if your children are being looked after by the Local Authority either under a Care Order or voluntarily.

What orders can be made?
The Local Authority could apply for either a Care order or a Supervision order. A Care order places the child in the care of the Local Authority and they will acquire Parental Responsibility along with those who already have Parental Responsibility for the child.
A Supervision order is an order whereby the Local Authority will remain involved with the child for a specified period. The Local Authority does not obtain Parental Responsibility for the child.
How much will it cost?
If you are the natural parent of a child who is in care and Court proceedings have been issued then you will automatically qualify for Public Funding (Legal Aid) irrespective of your means.
If you are not a natural parent and do not have Parental Responsibility we will need to make an application in the usual way.
Will I be able to see my child?
Once a child is being looked after by the Local Authority they must endeavour so far as it is practicable and consistent with the child’s welfare to promote contact between a child and his/her parents, and other persons connected with him/her.
Who is the Guardian?
The Court will appoint a Guardian for the child. This person is independent and is appointed to represent the child’s interest.
How long will the Court procedure take?
Since November 2003, any new cases issued are to be completed within 40 weeks from start to finish. There will be a number of Court hearings involved and many documents to file.
Which Court will my case be heard?
Generally all matters are heard in the Family Proceedings Court which is part of the Magistrates' Court; sometimes they are transferred to the County Court.
