Tier 1 Investor, Business Development and Talent Visas

The UK welcomes individuals who have specialist skills or who are looking to invest large sums of money into the economy. At Chattertons, we have specialist immigration solicitor, Kate Hollyer, who has nearly a decade of expertise helping individuals and their families obtain all types of visa.

Investor, business development and talent visas are highly sought after, but have strict requirements. The immigration rules on such visas have also recently changed. From 1 January 2021, all non-UK and non-Irish citizens must normally obtain a visa before they can live and work in the UK, including nationals from the European Economic Area (EEA).

Therefore, getting the right advice before applying can often mean the difference between an approval and a rejection. We have a strong track record of success in this area and can provide all the advice and support you need in relation to all types of visa, including:

  • Tier 1 (Investor) visas – for High Net Worth individuals making a substantial financial investment in the UK
  • Global Talent visas (formerly Tier 1 (Exceptional Talent)) – for “leaders or potential leaders” in the fields of academia or research, arts and culture or digital technology
  • Innovator visas – for established entrepreneurs looking to set up an innovative business in the UK that is different to anything else on the market
  • Start-up visas – for aspiring entrepreneurs looking to set up an innovative business in the UK that is different to anything else on the market

The Innovator and Start-up visas have replaced the Tier 1 (Entrepreneur) and Tier 1 (Graduate Entrepreneur) visa routes.

For advice about all types of UK visa, get in touch with our specialist immigration solicitor by contacting your local Chattertons office or filling in our online enquiry form. We have offices in Boston (Main Ridge West and Wide Bargate), Bourne, Grantham, Horncastle, Lincoln, Newark, Sleaford, Spalding and Stamford.

Types of investor, business development and talent visas that we can assist with…

Tier 1 (Investor) visas

You can apply for a Tier 1 (Investor) visa to live, work and study in the UK if you are able to make an investment of at least £2 million in the UK and fulfil other immigration requirements, such as evidence the source of the funds. Once granted, the visa holder is free to work, study, establish a business, or do nothing whilst living in the UK.

The more you are able to invest, the faster your route to indefinite leave to remain (rather than waiting 5 years on the £2 million route, with £5 million you could apply after 3 years, and with £10 million after 2 years).

You can also bring your spouse or partner and children under 18 without having to evidence maintenance funds. However, in most circumstances family members are not able to benefit from the accelerated route to indefinite leave to remain via a higher investment amount.

Our immigration solicitor, Kate Hollyer, has particular expertise advising about this type of visa. So, visit our High Net Worth Investor visa page for more information about our service.

Innovator visas

The new Innovator visa is one of the replacements for the former Tier 1 (Entrepreneur) visas and Tier 1 (Graduate Entrepreneur) visas. This type of visa is particularly suitable for established professionals and entrepreneurs.

You can apply for an Innovator visa if (amongst other requirements) you want to set up a new innovative business that has been assessed by an endorsing body (such as an investment firm) and you have at least £50,000 investment funds. If you already have an established business, you do not need to prove that you have investment funds.

You can also bring your partner and children to the UK as your dependants if they are eligible.

Start-up visas

The new Start-up visa is one of the replacements for the former Tier 1 (Entrepreneur) visas and Tier 1 (Graduate Entrepreneur) visas. This type of visa is particularly suitable for aspiring entrepreneurs.

Like an Innovator visa, you may be eligible for a Start-up visa if you want to set up an innovative business in the UK and have been assessed by an endorsing body (such as a higher education institution). You do not have to prove investment funds, but must be able to financially support yourself.

You can also bring your partner and children to the UK as your dependants if they are eligible.

Global Talent visas

You can apply for a Global Talent visa (which replaces the Tier 1 (Exceptional Talent) visa) if you are a leader or potential leader in one of the fields of academia/research (in science, medicine, engineering or humanities), arts and culture or digital technology. You must be endorsed to prove that you are a leader or potential leader.

You can also bring your partner and children to the UK as your dependants if they are eligible.
