Increase to Employment Tribunal compensation limits

  • Posted

The Employment Rights (Increase of Limits) Order 2020 has been laid before Parliament. From 06 April 2020, the Order will implement a number of changes to compensation limits, such as: -

  • The limit on a 'week's pay' will be increased from £525 to £538. This will be relevant for matters such as statutory redundancy pay and basic awards for unfair dismissal;
  • The maximum compensatory award which can be claimed in an unfair dismissal claim will be increased from £86,444 to £88,519;
  • The minimum basic award in claims of unfair dismissal by virtue of health and safety, trade union membership, employee representative or occupational pension trustee reasons will be increased from £6,408 to £6,562.

The new rates will only apply where the event leading to compensation or payment occurs on or after 06 April 2020. The 'old limits' will apply for any dismissal or relevant event occurring before this date.
